1. The Service Fee will be separate from all other fees payable in accordance with these conditions.
2. A Booking Fee will be required on signing of the contract with the balance of the service fee due and payable on the positive results of a pregnancy test, certified by a qualified Veterinary Surgeon. This booking fee is not refundable but deductible from the service fee.
3. Free Return. A negative test, a still born foal, or the death of the foal within 24 hours of birth will on receipt by the stud of certificate of death by a Qualified Veterinary Surgeon, entitles the owner of the mare to return the same or substitute mare to the stallion during the next following year only. In the event of the mare failing to conceive of if again a live foal is not produced, the service fee will be forfeited to the stud and the studs commitments under this contract will be deemed to have been fulfilled. If the stallion dies or is not available at the time of mare return, a service will be available from a resident stallion at the time.
4. Mare. All mares must be tractable, wormed and in good condition.
5. Agistment. For mares during the breeding season will be charged a rate per week, or part three of. Mare and foal will also be charged a rate per week or part three of.
6. Veterinary Attention deemed necessary by the stud master including follicle and pregnancy testing will be paid for by the owner of the mare.
7. Removal of the mare from the stud can only be effected after the payment in full of all stud fees including agistment and veterinary fees. The stud reserve the right to defray costs any unpaid accounts due by selling the mare and or foal if such accounts are not paid at the end of a three-month period from the date of service.
8. Loss or Injury or damage to the mare or foal. All care and attention will be extended to the mare and or foal by the stud master, during their stay at Backwater Stud, Lot 50 Backwater Road, Greenbank, however the owner acknowledges and accepts that the stud or the stud master shall not be held liable for any loss or injury or damage to the mare and or foal while on the property at Backwater Stud, Lot 50 Backwater Road, Greenbank.
9. Mare and or Foal are to be removed from the stud within 14 days of a positive pregnancy test unless otherwise arranged.
